Terms Of Service - Individual

KryptoGO Co., Ltd. (hereinafter referred to as "KryptoGO" or "we") provides users certain software services accessible via web browser and/or a mobile device applications, including non-custodial Externally Owned Account (EOA) wallets (collectively referred to as "KryptoGO Wallet" or "the Wallet").

KryptoGO Wallet enables users to: (i) access digital assets; (ii) access a digital asset browser and link to third-party decentralized exchanges (Decentralized Exchanges, "DEXs") and third-party decentralized applications (Decentralized Applications, collectively with DEXs, "DApps"); (iii) view addresses and information that are part of digital asset networks and broadcast transactions; and (iv) other functions that KryptoGO may add to the Wallet from time to time (collectively, the "Services"). These Terms of Service ("Terms") are to clearly define the terms that govern your use of all versions of the Product and the Services. These terms and additional information about the Product can be found at https://www.kryptogo.com/wallet.

Important Notice: KryptoGO Wallet is a non-custodial wallet and does not provide digital asset custody services. You are solely responsible for the safekeeping of your private keys and digital assets.

Agreement to Terms

By clicking the "Agree to Terms" button, or by accessing the Wallet through any means or using any or all of the Services, you agree to be bound by these Terms. If you do not agree to be bound by these Terms, you may not access or use the Services.

Please ensure that you carefully review the sections regarding "Limitation of Liability" and "Warranty Disclaimers" in these Terms.

Privacy Policy

KryptoGO values your privacy. When you use the Services, we will collect, use, and disclose your information in accordance with KryptoGO Wallet’s Privacy Policy (the “Privacy Policy”). Please carefully read the Privacy Policy to understand your rights and our data handling practices.

Changes to Terms or Services

KryptoGO reserves the right to modify these Terms and the Services at any time at its sole discretion. If we do so, we’ll let you know either by posting the modified Terms on the Site, by providing you a notice through the Product, or through the email address associated with your account. The modified Terms will be effective at the time they are posted on the Site. It’s important that you review the Terms whenever we modify them because if you continue to use the Services after we have modified the Terms, you are agreeing to be bound by the modified Terms. If you don’t agree to be bound by the modified Terms, then you may not use the Services. Because our Services are evolving over time we may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.

Who May Use the Services

1. Eligibilty

You may use the Services if you are 18 years or older and are not barred from using the Services under applicable law.

1.1 To Parents or Legal Guardians: KryptoGO Wallet is a digital asset wallet and involves a degree of complexity and risk that may not be suitable for all users. If you allow your child (between the ages of 13 and 18) to use KryptoGO Wallet, you acknowledge and agree that you are responsible for:

  • Reviewing these Terms and explaining them to your child.
  • Closely monitoring their use of the Services, and ensuring that your child possesses sufficient cognitive ability to comprehend and assume the risks associated with using the Services (including, but not limited to, operational errors, scams, and asset loss).
  • KryptoGO, to the fullest extent permitted by applicable law, shall not be liable for any losses arising from your child's improper use of KryptoGO Wallet, including, but not limited to, unauthorized transactions.

2. Prohibited Persons

You represent and warrant that you are not:

2.1 Subject to sanctions or otherwise prohibited from transacting under the laws of the Republic of China (Taiwan) or any other applicable jurisdiction.

2.2 Located in, or a resident of, a high-risk jurisdiction, or an individual or entity controlled by the laws of such jurisdiction.

3. Account Registration Obligations

To use the Services you are required to create an account (“Account”), by that you agree to:

3.1 Keep your Account credentials (e.g., username, password, two-factor authentication codes) secure and confidential, and not disclose it to any third party.

3.2 Notify KryptoGO Customer Support immediately via contact@kryptogo.com of any unauthorized use of your Account, and provide accurate and up-to-date information throughout the duration of the incident.

3.3 Be fully responsible for all activities that occur under your Account, or are otherwise referable to your Account credentials, whether or not you know about them.

3.4 KryptoGO reserves the right to suspend or terminate your Account if you provide any inaccurate, untrue, or incomplete information, or if you fail to comply with the Account registration requirements or these Terms.

Recovery Phrase and Private Keys

You are solely responsible for maintaining the security of your Account credentials, the Recovery Hhrase for your Wallet (the "Mnemonic Phrase"), and the unique digital or hardware credentials associated with your Wallet (e.g., iCloud and Google Private Keys, hardware authentication devices such as Yubikeys) ("Private Keys"). Please ensure that you regularly verify the effectiveness of your backups to ensure you are able to recover your digital assets in the event of an unforeseen issue.

Your Recovery Phrase and/or Private Keys are the sole means of accessing the digital assets within your Account. Any person who obtains access to your Recovery Phrase and/or Private Keys may control your digital assets. If you lose your Recovery Phrase and/or Private Keys, you will be unable to access your digital assets in the Wallet. By agreeing to these Terms, you acknowledge that KryptoGO does not store and is in no way responsible for the safekeeping of your Recovery Phrase and/or Private Keys. KryptoGO and its affiliates shall not be liable for any losses arising from your loss of Recovery Phrase and/or Private Keys, and shall not be responsible if you lose access to your digital assets due to the loss of your Recovery Phrase and/or Private Keys.

Feedback

KryptoGO welcomes your feedback, comments, ideas, and suggestions for improvements to the Services ("Feedback"). You may submit Feedback via contact@kryptogo.com. You agree to grant KryptoGO shall be free to use, reproduce, modify, create derivative works from, distribute, and otherwise exploit such Feedback for any purpose, without any compensation to you. KryptoGO has the right to decide whether to adopt your Feedback, and does not guarantee that all Feedback will be implemented.

Ownership and Control

You own and control the digital assets held in your Account and shall bear all risks associated with such digital assets, including but not limited to fluctuations in value, loss, or theft.

You understand that the prices of digital assets are highly volatile and may decrease significantly in value, and you should exercise caution and prudence in making any investment decisions. KryptoGO does not guarantee the value of digital assets, nor shall it be liable for any losses resulting from market fluctuations.

You may transfer your digital assets to another blockchain address at any time, subject to outages, downtime, and other applicable policies, and shall bear any delays resulting from network congestion or exchange limitations. By using the Services, you acknowledge that you are NOT transferring ownership of your digital assets to KryptoGO or its affiliates at any time.

Content Ownership, Responsibility and Removal

1. Content Definition: For purposes of these Terms

1.1 "Content" means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided, or otherwise made available through the Services.

1.2 "User Content" means any Content that Account holders (including you) make available through the Services.

1.3 "KryptoGO Content" means all Content except for User Content.

2. Ownership of User Content

KryptoGO does not claim any ownership rights in any User Content, and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit your User Content.

3. Ownership of KryptoGO Content

The Services and KryptoGO Content, including all associated intellectual property rights, are proprietary to KryptoGO and its licensors. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services or the KryptoGO Content.

4. Warranty of User Content

You warrant that you have all rights necessary to submit your User Content and that such User Content does not infringe the intellectual property rights or any other rights of any third party.

5. Content Removal

You acknowledge that, in certain instances, even after you remove your User Content by deleting it, some of your User Content (such as posts or comments you make) may not be completely removed and copies of your User Content may continue to exist on the Services. KryptoGO shall not be responsible or liable for the removal or deletion of (or the failure to remove or delete) any of your User Content. KryptoGO reserves the right to remove content that violates any applicable law, regulation, or these Terms.

Rights in Content Granted by KryptoGO

Subject to your compliance with these Terms, KryptoGO grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, view, copy, display, and print the Content solely in connection with your permitted use of the Services.

Fees

KryptoGO may charge fees for certain transactions you undertake using the Wallet, and we reserve the right to modify such fees and billing methods at any time. KryptoGO will clearly disclose any applicable fees prior to your use of the relevant Services.

Third-Party Service Fees: You may incur charges from third parties for use of linked Services (e.g., DApps, DEXs). These fees are charged by the third-party service providers and are not collected or paid to KryptoGO. Gas fees are paid to blockchain network miners and are not collected by KryptoGO.

Acceptable Use and Enforcement Rights

You agree not to use the Services in ways that:

1.1 Violate the rights of KryptoGO, other users, or any third party, including, but not limited to, rights of privacy, publicity, intellectual property, etc.

1.2 Are illegal, or promote illegal activities, including but not limited to money laundering, fraud, and terrorist financing.

1.3 Distribute false information, engage in malicious attacks, or harass, threaten, or intimidate other users.

1.4 Disrupt or interfere with the proper functioning of the Services.

1.5 Circumvent any security measures implemented by KryptoGO to protect the Services.

1.6 Access or use another user’s account or information without authorization.

1.7 Distribute malware, viruses, or other harmful code.

1.8 Violate any applicable law or regulation.

KryptoGO reserves the right to remove User Content that violates these Terms and to terminate the access of any violator, at its sole discretion and without prior notice.

Third Party Materials and DApp

The Services may contain links to third-party websites and DApps ("Third-Party Services"). You acknowledge and agree that:

1.1 KryptoGO provides such links solely as a convenience to users and does not endorse, warrant, or guarantee the availability, legality, or security of any Third-Party Services, or the accuracy of their content.

1.2 You are solely responsible for assessing the risks associated with using Third-Party Services and for taking appropriate precautions.

1.3 Interacting with DApps may involve high risks, including but not limited to smart contract vulnerabilities, rug pulls, and asset losses. You should ensure that you fully understand such risks before proceeding.

1.4 KryptoGO shall not be liable for any losses resulting from your use of Third-Party Services.

Important Notice: KryptoGO make no warranties or representations, express or implied, about such linked Third Party Materials. You are solely responsible for exercising your own judgment and assuming all risks associated with your use of Third-Party Services.

Termination

KryptoGO may terminate your access to the Services at any time, with or without cause, and with or without notice. You may also terminate these Terms by discontinuing your use of the Services and deleting your Account.

Upon termination of these Terms, all rights granted to you hereunder will immediately terminate, and you must cease all use of the Services. The following sections will survive termination: User Feedback, Ownership of Content, Limitation of Liability, Disclaimers, Indemnification, Dispute Resolution, and General Terms.

Warranty Disclaimers

1. Services "As Is"

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, and non-infringement. Your use of the Services is at your sole risk.

2. Private Key Safekeeping

You are solely responsible for maintaining the confidentiality and security of your Private Keys and Recovery Phrase. KryptoGO cannot access or recover your Private Keys and Recovery Phrase, and if you lose your Recovery Phrase and/or Private Keys, you will lose access to your digital assets. Please ensure that you back up your Recovery Phrase and Private Keys securely.

3. Service Stability

KryptoGO will endeavor to maintain the stability of the Services, but does not guarantee that the Services will be uninterrupted, timely, or error-free at all times. You understand and agree that the Services may be subject to interruptions due to:

3.1. Routine or emergency maintenance of system equipment.

3.2. Telecommunications carrier line failures.

3.3. Force majeure events, such as natural disasters or acts of war.

3.4. Other factors beyond KryptoGO's reasonable control.

4. Third-Party Service Risks

KryptoGO makes no representations or warranties regarding the safety, legality, or functionality of any Third-Party Services (including DApps). You are solely responsible for assessing the risks of using Third-Party Services and assuming all associated liabilities.

5. No Investment Advice

The Services are provided solely as a digital asset management tool, and KryptoGO does not provide any investment advice. You are solely responsible for evaluating investment risks and making your own investment decisions.

Limitation of Liability

To the maximum extent permitted by applicable law, KryptoGO and its affiliates shall not be liable for any damages (including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages) arising out of or in any way connected with your access to or use of, or inability to access or use, the Services, including, but not limited to: loss of access credentials, loss of digital assets, errors in transaction processing, or losses caused by DApps.

Indemnification

You agree to indemnify, defend, and hold harmless KryptoGO and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, infringement of any third party's rights, or your unlawful conduct.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services, you agree to contact KryptoGO’s customer service at support.kryptogo.com. If you wish to submit a written dispute via email, please include as much information as possible when submitting your request, including but not limited to your case number, how you would like us to revolve the dispute, and any other relevant information, and send to contact@kryptogo.com. The formal dispute process will be completed when KryptoGO responds to you or 45 business days after we receive your submission (whichever first). You agree to complete the formal dispute process before submitting any arbitration requests.

General Terms

1. Entire Agreement

These Terms constitute the entire and exclusive understanding and agreement between KryptoGO and you regarding the Services, and supersede all prior agreements and understandings, whether oral or written, relating to the Services.

2. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms shall remain in full force and effect.

3. No Assignment

You may not assign or transfer these Terms, in whole or in part, without KryptoGO’s prior written consent.

4. Notices

KryptoGO may provide any notice required or permitted under these Terms by posting such notice on the Website or within the Product, and/or by other forms of electronic communication.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan).

6. Language

These Terms are written in English. Any translated version is provided solely for your convenience. To the extent any translated version of these Terms conflicts with the English version, the English version shall prevail.
